Artificial Intelligence and the Challenge to Traditional Civil Liability Rules
Keywords:
Artificial intelligence, tort liability, legal personhood, product liability, liability for the acts of things.Abstract
This study examines the legal issues arising from the development of artificial intelligence technologies, particularly in relation to liability for damage caused by intelligent systems. The autonomous ability of these technologies to learn and make decisions weakens the effectiveness of traditional civil liability rules and raises questions about who should bear responsibility: the programmer, the user, or the system itself. The study explores the possibility of granting legal personality to AI and adapting strict liability rules, such as product liability, to hold these systems accountable. It concludes that the current legal framework is insufficient and requires legislative reform to protect individuals and keep pace with technological progress.
