The High Authority for Transparency, Prevention of and Fight against Corruption

Abstract

The fight against corruption has become a major priority for the Algerian legislator, prompting institutional and constitutional reforms aimed at strengthening transparency, prevention, and the fight against corruption. In this context, the 2020 Constitutional Amendment established the High Authority for Transparency, Prevention of and Fight against Corruption as an independent constitutional institution with supervisory functions. This study examines its constitutional and legal framework, assesses the scope of its powers and institutional independence, and identifies the main challenges affecting the effective implementation of its mandate, particularly at the regional level. Using a descriptive-analytical approach based on relevant constitutional and legislative provisions, the study finds that certain aspects of the Authority’s composition and institutional organization may limit the effective exercise of its powers. The absence of territorial delegations also constitutes a structural constraint on extending its activities and ensuring effective anti-corruption action at the regional level. The study concludes that strengthening institutional independence, clarifying powers, and establishing territorial mechanisms are essential to enhancing the Authority’s effectiveness.
